Failure to pay a toll can result in additional fees and criminal charges against the registered owner of the vehicle. Here are the steps a Pay By Mail customer can expect if a toll invoice is unpaid:
Non-Payment Fees
Failure to Pay
- Toll Bill: tolls + $1 processing fee
- Notice of Non-Payment: (30 days past due) unpaid tolls + unpaid fees + $15 non-payment fee per invoice
- Second Notice of Non-Payment: (60 days past due) unpaid tolls + unpaid fees + $15 non-payment fee per invoice
- Final Notice of Non-Payment: (90 days past due) unpaid tolls + unpaid fees + $15 non-payment fee per invoice
- Legal Action (per toll, after 120 + days of nonpayment): subject to criminal misdemeanor charge + toll + court fees + up to $250 special fine per unpaid toll
Legal Action
Under Texas law, someone who fails to pay a toll may be charged with a criminal misdemeanor for toll evasion under Chapter 370.11 of the Texas Transportation Code. If found guilty, the registered owner of the vehicle can face fines of up to $250 per unpaid toll in addition to court administrative fees.
Habitual Violator
One hundred unpaid tolls within a year may lead to vehicle registration block, vehicle ban, as well as criminal misdemeanor charges, a fine up to $500, and impoundment of the vehicle if the ban is violated.
